RESPONSIBILITY.

The detailed conditions and modalities below are an integral part of the travel contract concluded between us and you, the participant in the trip. Also part of this contract are the conditions and remarks found inside this catalog. We draw your attention to the fact that our contract differentiates between package tours and a la carte arrangements. A package tour means that we publish a single price for accommodation and transport.

1. Registration and Conclusion of the Contract

The travel agency is your advisor and represents you with us. It transmits your registration request to us. Our confirmation to your travel agency is binding. If your payment is not transmitted to us on time, we reserve the right to withdraw from the contract.

2. Prices:

2.1. Booking Fees

2.1.a For a reservation of an "a la carte" program, fees of CHF 50 per person (maximum CHF 100 per file) will be charged.

2.1.b For a package arrangement including only land services (without round-trip flight from Switzerland), booking fees of CHF 50 per person (maximum CHF 100 per file) will be charged.

2.2. Price Increases

We reserve the right to increase prices in case of an increase in transportation costs (e.g., fuel costs), new or increased taxes (e.g., airport taxes), exchange rate changes, or state-imposed taxes (VAT). If applicable, we calculate the increase based on the actual additional costs. If the increase is more than 10%, you have the option to cancel your contract without charges within 5 days of the notification of the increase.

2.3. Program Modification

Akdeniz Travel Oguz reserves the right to modify its programs and prices if measures taken by its service providers or other unforeseeable or uncontrollable circumstances require it. In exceptional cases (e.g., overbooking), we reserve the right to inform you at short notice. We will strive to find you an equivalent alternative.

2.3.a Package Tours. In package tours, unforeseen changes (accommodation, transport means, service providers, schedules, etc.) may occur. In such cases, we will strive to find an equivalent replacement. Program changes do not entitle you to damage claims or compensation for lost wages, etc., but we will refund any difference between the lower value provided and that described in our services.

2.3.b Additional costs resulting from the extension of the trip or itinerary changes due to unforeseen circumstances are the responsibility of the trip participant.

2.4. "A la carte" Arrangement

We act as an intermediary between the client and the service providers mentioned in our brochure (transport companies, hotels, car rental companies, etc.). Therefore, we cannot guarantee the proper execution of these companies' services. However, we are responsible for selecting the companies called upon to provide services. In the event of damage, we will strive to help you enforce all justified claims.

2.5. Cancellation by the Travel Organizer

Akdeniz Travel Oguz reserves the right to cancel a trip no later than 30 days before departure if the planned number of participants is not reached. Compelling reasons remain reserved (force majeure, war, unrest, refusal or withdrawal of landing rights, etc.). For the same reasons, we reserve the right to interrupt a trip already in progress. In the event of cancellation on our part, you will receive a full refund of the trip price. In case of interruption, we will refund unused services. Damage claims are excluded.

3. Prices and Payment Terms

The prices indicated in the Akdeniz Travel Oguz brochure are per person, in Swiss francs, unless otherwise specified. For price changes, see § 2.2, 2.3, 2.3 a, 2.3 b, 2.4, 2.5.

3.1. Payment

At registration, the client must pay a minimum deposit of 25% of the total trip price. The balance must be paid up to 30 days before the set departure date. For late registration, the total must be paid at registration. If the booking office does not receive the deposit and payment within the prescribed deadlines, Akdeniz Travel Oguz may refuse travel services and assert cancellation rights according to § 4.

4. Booking Modification or Trip Cancellation by the Client

In case of a booking modification by the client, Akdeniz Travel Oguz will charge an amount of CHF 60 per person per file (maximum CHF 120 per file), plus any telephone and fax costs. A change of holiday date is considered a trip cancellation.

Furthermore, in case of cancellation by the client, the following fees will apply:

  • 31 days before the departure date: processing fee of CHF 200 per person.
  • 30 to 21 days before the departure date: 25% of the total trip amount.
  • 20 to 15 days before the departure date: 50% of the total trip amount.
  • 14 to 8 days before the departure date: 75% of the total trip amount.
  • 7 to 0 days before the departure date: 100% of the trip amount.

Any trip involving transport on a charter flight will be subject to specific conditions provided upon confirmation. If the canceling client finds a replacement person, only the processing fees will be charged. All costs incurred by a modification or cancellation by the client after the trip has started are entirely at their expense and cannot be refunded by Akdeniz Travel Oguz, including for services not provided as a result of these modifications or cancellations.

Scheduled flights, packages with scheduled flights, intercontinental flights, and domestic flights abroad: The conditions applicable to selected flights and rates based on the airline will be communicated to you before booking by our central office. Reservations of packages with scheduled flights are not subject to package cancellation conditions and will be examined on a case-by-case basis. The conditions of the respective airline and booking class apply.

Train Travel/Boat Travel/Various Additional Services: The cancellation conditions of our service provider apply.

5. Insurance

Cancellation, repatriation, and baggage insurance are not included in our package prices. If you are covered by such private insurance (e.g., ETI booklet), we offer you insurance through MONDIALE ASSURANCE, whose premium will be charged separately, at a price varying according to the services to be covered. If your trip must be canceled or delayed, the insurance company will reimburse cancellation fees up to the actual arrangement price. Additional costs for delayed departure will also be covered.

Insured events: serious illness, serious bodily injury, serious pregnancy complications, or death of the insured person, a person participating in the trip, a person close to the insured who is not participating in the trip, a replacement at work if the presence of the insured person at the workplace becomes indispensable, if the property of the insured person at home is seriously affected by fire, natural forces, theft, or water damage requiring their presence at home. Malfunction or delay of public transport means to be used to get to the official departure point in Switzerland (airport, departure station).

The unexpected termination of the employment contract by the employer of the insured person in the last 30 days before the trip, due to difficult economic conditions. If the person suffers from a chronic illness without this appearing to prevent their participation in the trip at the time of booking, MONDIAL ASSISTANCE reimburses the insured costs resulting from cancellation due to an acute exacerbation of this illness. The same applies in the event of death of the insured person due to chronic illness. Anyone registering for one of our trips is required to be covered by cancellation and repatriation assistance insurance. Baggage insurance is left to individual discretion.

6. Passports, Visas, Vaccinations

Travelers must ensure they comply with the regulations in force at the time of the trip. Your travel agency will inform you about entry formalities (passport and visa) and health precautions. Akdeniz Travel Oguz assumes no responsibility if a passenger does not comply with these regulations. If they miss their flight (invalid passport, etc.), they lose all transport rights and cannot claim compensation or reimbursement.

7. Complaints

If the services provided do not correspond to the description in the brochure or there is a major defect, the client must immediately contact the tour leader, our correspondent, or the relevant service provider, asking them to remedy the problem. If their intervention does not provide a solution within a reasonable time, if no help is possible or if it is insufficient, the client must obtain a written document from our representative or the relevant service provider confirming the content of the complaint. The complaint must reach us in writing within 30 days of the return date.

8.1 Responsibility of Akdeniz Travel Oguz

We will credit you with the amount of the agreed services not provided or provided unsatisfactorily, as long as our correspondent or service provider was not able to offer you an equivalent replacement service on-site and that fault can be attributed to us or our service provider.

8.2 International Conventions and National Laws

If international conventions and national laws provide for restrictions on compensation for damage due to non-performance or incomplete performance of the contract, we can refer to these and assume our responsibility only within the framework of these conventions and laws. International conventions and national laws with liability limitations apply particularly in the area of transportation (air, rail, river, or sea traffic).

8.3 Liability

Our liability is not engaged when non-performance, incomplete performance of the contract, or damage is due to the following reasons:

  • Negligence on the part of the client before or during the trip
  • Unforeseeable or unavoidable negligence of a third party not participating in the agreed contractual service
  • Force majeure or an unforeseeable or unavoidable event by us, the intermediary, or the service provider, despite due care.

In all these cases, any obligation of compensation on our part is excluded.

8.4 Personal Injury, Accidents, etc.

For personal injuries, deaths, bodily injuries, etc., due to non-performance or incomplete performance of the contract, our liability is engaged only if the damage was caused by us or our service providers. Subject to liability limitations in international conventions or national laws (§ 8.2, 8.3).

8.5 Property Damage and Losses, etc.

For other damages attributable to non-performance or incomplete performance of the contract, our liability is engaged only if the damage is due to negligence on our part or that of a service provider. Our liability is limited to double the trip price, subject to lower liability limits in international conventions or national laws.

8.6 Valuables, Money, Jewelry, Credit Cards

We expressly draw your attention to the fact that you are personally responsible for the safe keeping of valuables, money, jewelry, photo and video equipment, etc. In hotels, these items must be deposited in a safe. Our liability cannot be engaged in case of theft, loss, damage, etc.

8.7 Flight, Train, Bus, Boat Schedules

It is impossible for us to guarantee the adherence to these schedules, despite careful travel organization. In case of delays by transport companies, for whatever reason, we assume no responsibility for damages, such as wage loss, additional hotel nights, meals, unprovided services, etc.

8.8 Events During the Trip

Outside the agreed travel program, it is possible to book local events or excursions during the trip. It is not excluded that these events or excursions involve certain risks. If you participate in these events or excursions, you do so at your own responsibility for any possible damages.

8.9 Cures, Beauty Weeks, etc.

Medical cures are performed under medical supervision, beauty cures under the supervision of specialists. We transmit these offers and therefore cannot be responsible for the doctors, specialists, and assistants or the success of the treatment, nor assume any responsibility.

9. Guarantee

We are members of TPS and therefore guarantee that you will receive the services you have subscribed to.

Draft Date: This draft was completed in January 2011. Akdeniz Travel Oguz reserves the right to make changes after this date concerning the indicated figures and prices. Therefore, please consult your travel agency before booking.

Legal Venue: In case of dispute or litigation, only the court of Lausanne is competent, and Swiss law is applicable.
